1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the services provided by XINXIANG LEI trading as Eddie Studio (ABN: 49 214 130 699) (“we”, “us”, “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

Eddie Studio provides digital products including web applications, mobile application subscriptions, AI-powered tools, and related digital services (“Services”). Specific features, pricing, and availability of Services may change from time to time at our discretion.

3. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you have the legal capacity to enter into a binding agreement.

4. User Accounts

Some Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

5. Payment Terms

  • All prices are quoted in Australian Dollars (AUD) unless otherwise stated, and are inclusive of GST where applicable.
  • Payments are processed securely through Stripe. We do not store your payment card details.
  • Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).
  • You authorise us to charge your designated payment method for all fees incurred.

6. Refund & Dispute Policy

We want you to be satisfied with our Services. Our refund policy is as follows:

  • Subscription Services: You may request a full refund within 14 days of your initial purchase if you are not satisfied. After 14 days, refunds are provided on a pro-rata basis for the unused portion of your subscription.
  • Custom Development / Web Solutions: Refunds for custom work are assessed on a case-by-case basis depending on work completed. Milestone-based payments already rendered for completed milestones are non-refundable.
  • Disputes: If you have a billing dispute, please contact us at leiofficial@eddiest.com within 30 days. We will work with you in good faith to resolve the matter promptly.

Nothing in this policy excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law.

7. Cancellation Policy

  • You may cancel your subscription at any time through your account settings or by contacting us via email.
  • Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of that period.
  • No partial refunds are issued for the remaining days in the current billing cycle, unless required by Australian Consumer Law.
  • We reserve the right to cancel or suspend accounts that violate these Terms, with or without notice.

8. Intellectual Property

All content, code, designs, trademarks, and materials provided through our Services are the intellectual property of Eddie Studio or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent, except as expressly permitted by these Terms or a separate agreement.

9. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the integrity of our Services
  • Upload malicious code, viruses, or harmful content
  • Resell or redistribute our Services without authorisation

10. Limitation of Liability

To the maximum extent permitted by law, Eddie Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services. Our total liability to you for all claims arising from or related to these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law, including liability under the Australian Consumer Law.

11. Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Services, except as required by the Australian Consumer Law.

12. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or through a notice on our website. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
